A group of the citizens went further to issue a duly signed document rejecting the decree in totality. The document addressed to the Governor and obtained by The Citizen newspaper reads as follows: Reference is made to your Decree No. 28/2011 regarding appointment of a Mayor of Malakal City.

We have our objections to the decree on the following grounds:

1. The creation and establishment of Local Government Councils is entirely the prerogative of the President upon recommendation of the State Government and committee referred to in sub-section (4) Article 20 (3) & (4) (local Government Act, 2009).

2. Each local Government Council shall be established by warrant showing its jurisdiction,

type of authority, territorial boundary and a map of its area duly signed by the President and attached Article 20(5) Local Government Act, 2009.

3. The created and established Malakal City Council has no warrant of establishment from the President.

4. Makal County Council is created and established by the order No. 003/10/2004 issued by late Cdr. Dr. John Garang De Mabior, Chairman and Commander -in- Chief, SPLM/A dated 16th October 2004.

(The order is attached) and is graded in grade (A) category of the local Government Councils as A Municipal Council and not a City Council. Therefore, Makal County Council is a corporate body and established by Law and cannot be dissolved or abolished except by an order issued by the President, Article 20 (7) of the Local Government Act, 2009.

However, the creation and establishment of Malakal City Council within Makal County creates political and administrative inconvenience in the county. Therefore, we request your good self to re-study

the Decree No. 28/2011 in question by repealing it in the interest of the people of Upper Nile State in general and Makal County in particular. The document was signed by the following personalities:

The document was copied to the President of the Republic, Speakers of both South sudan legislative Assembly and Council of States and of Upper Nile Legislative Assembly and Ministers of National Security (President’s Office), of Local government and Law Enforcement, Legal Affairs and Constitutional Development in Upper Nile State and the Reth of Shilluk.
