Subject:Petition to the governor of Great Upper Nile State, Republic of South Sudan.
Request: Invalidation or nullification of unconstitutional appointment of mayor of Makal City.
Dear your excellency, the governor of the Great Upper Nile State, Mr. Simon Kun,
allow us first to express our heartfelt and desire for governing principles we dream of for the management of our affairs, to remind you of our previous grievances and to ask you to reconsider your decision to appoint mayor of Makal city.
Values for coexisting: The fabric governing model of each tribal society in the Republic of South Sudan is the woven of transparency, accountability, responsibility, justice, freedom, democracy, respect, equality and geography. These principles define ever tribal community as an independent state within old Sudan and perpetuate internal peace, harmony and wellbeing of our communities. Ever community in single village demonstrates this societal behavior during village parliamentary setting under tree where villagers debate on various issues in a transparent manner. Southern tribes continued practicing this democratic administration until oppressors (Arabs) conquered our land.
Effects of oppressive administration: Lord Jesus said He did not come to destroy, but to reconcile, forgive and to heal. But our oppressors did the opposite. They conquered our land, created a single state and accommodated various ethnic communities of South Sudan without pre-social contract or question about how to live our life under united old Sudan. They replaced the precedential governing principles of our tribal communities with divisive regulations, laws and policies. They divided us against each other by imposing on us nominal leaders who resemble themselves with wolves in human clothes. They killed our wise leaders, destroyed our social settings and deleted our values that once governed us and left our people in chaotic and barbaric life without rule of law, responsibility and accountability.
War of Independence: The people of the Republic of South Sudan had waged a liberation war of independence that went on between the South and North Sudan for decades. Going to war was a choice between death and life without freedom. Such sacrificially national war was fought with promise to restore hijacked principles of justice, democracy, equality and freedom which now are enshrined in the CPA, State and National constitution of the Republic of South Sudan. No human heart, mind or eye can accept bearing, hearing or seeing the same demonic or satanic administration repeating itself after July 09, 2012 because of the birth of southern nation rather than tribes during old Sudan. Saying of Native Americans: “No tree has branches so foolish as to fight amongst themselves.”
Devolution of power: Both State and national constitution of the Republic of South Sudan urges for devolution of power which is interpreted as taking power to village or close to governed people (subjects). Implementation of this constitutional provision occurs by investing governmental power through official election of a fit Mayor or Commissioner by populace choice of city or county’s inhabitants. In this manner, we are honoring our martyrs who have chosen death than life without freedom. Widow of our hero, Dr. John Garang said during funeral raising up in her hand document of the CPA, “My children, if you do not want my husband to die in vain and if you do not want me to cry, honor and implement the provisions of this document (CPA)”. Like any other governor in the Republic of South Sudan, the office of the Upper Nile State governor is bounds to state constitution and governor should therefore construe constitutional provisions to act within constitutional terms and laws for the maintenance of constitutional structure and good governance. However, the governor of Great Upper Nile State usurped people’s power by his unconstitutional designation of Mayoral position of Makal city to his relative. This move is a clear violation of constitution and governor’s vows he solemnly promised to the people of Great Upper Nile State by invoking God’s name that he will perform and serve in accordance with constitutional provisions and laws. It is also a second assassination of our martyrs that die in vain.
Invalidation of governor’s appointment: After a careful study of the nature of governor’s decision to allocate mayoral position of Makal City to his relative, we the members of Chollo Community in Canada have concluded that the governor has abused and violated his constitutional power. This move breached statutory provisions and is an act of invading people’s constitutional prerogatives and freedom and continuity of old Sudan principle of divide and rule. As a result, we strongly urge the governor to make a morally responsible decision to invalidate or nullify his unconstitutional appointment of Makal City Mayor.
