Daer All,
I have come to understand that my initiative to let us petition the court regarding this issue is unpopular among the majority of our people. There are other options suggested like the ICC and military confrontation with Jango including the SPLA if it comes in support of occupation of our land.
The rejection of my initiative is based on the fear that the courts in the South Sudan are predominantly run by Jango and therefore a waste of time and money as we may not get justice in our favor. I thought going to the court is the cheapest.My main fear is that the Transitional Constitution has been tabled on the floor of the SSLA and will have to be passed before the 9th July, 2011.I have had the experience of how Constitutions and other laws are dealt with by parliaments and in fact I worked as a member of a Constitution Commission and also on the Local Government Law Commission. I am dead sure that the Transitional Constitution will be passed by the SSLA in a package together with other laws especially the Local Government Act which will give the President the power to decree Warrants of Establishment of the various Counties in our new country. HE Kiir told me that there were already 80 counties and there were some 65 applications more.
I gave him my opinion based on my experience on the Local Government Law Commission. Of course Piji and Akoka had already been announced and were among the 80 in existence, although being contested by us. The good thing is that all the 80 counties in existence do not have warrants of establishments up to this date. So why do we not give an alarm to both the SSLA and the court that we have a point of contention over certain counties established by the government which are affecting us, but without consulting with us?. If the SSLA passes this package of the Constitution and other laws they will become law of the country and game up for the Nyikango Kingdom .
My sense now is that any person who may continue to ask me IFS and Buts on this case has a different agenda and not the Chollo Land . I am just asking for money and I will complete the rest with the lawyers. After all if I die today you will definitely take my remains home at a charge much more compared to the amount I am asking you for the court.

Dear father james ogilo thank you for your opinion. and also you are experience politician, any way let us forget this as you put it that all law under jango at this time i think nothing can be done as long as kirr still in power as you can see now south sudan is on fire.during the campaign last year 2010 election Dr lam he will prevened the corruption discrimination all above problem which is facing goss today.again he said if southern sudan chose secession it would be suicid as evidence an independen of south would be chaotic and lawless much like somalia under these weak goverment so in my opinion let us not wasting our time by going to the court with this goverment,thes goverment will not listen and never give up we will get our kingdom land after if they gone. but not now.

father ogilo let us be honest and tell the truth.itis useles to talk to the the goverment of the south sudan for chollo land.obviously these goverment will not do anything concern about chollo our petition will not change any thing all.how many time we did this even you your self and chollo community in us send pitition letter during 2010 when chollo was killed in anadiar and pachodo.now my question is why dont,you ask our king kongo?because chollo land be long to the king, all these years chollo was sufering in the hand of spla while king did not act. what is the meaning of king silent.our late king ayang was controling peace full land of choollo now you are elder you want chollo people to gether some money for land case,why dont you go to the king first. this will not work at all, father. gol deng will not give us chance itis some thing that has been plan for years in cluding those who support splm wad chollo. now there are many defference army in south but they do not care. they only care about Dr lam akol beacuse is the only man who challenge the goss. he is the one can bring the change like obama.he is the one who can stop corruption and loting money discriminationg and land gribing and peacefull Dev:goverment of south sudan has fail in defference level.thank i will see you in obay my village in the future.

My comment to Uncle Ogilo is why do not you travel to Sudan, I mean North Sudan where the majority of Collo IDP are settled to find out their numbers and what are reasons preventing them to return to South.Of course, many are aware of insecurity in Collo land due to Jang occupation of their villages the only place they return to.
My suggestion is:instead of going to the court to raise the case of Collo land which is not popular among majority of collo because of perceived failure becu of simple fact that the majority of Judges are from Jang and second the Judiciary in South is not independent and much worst is politicized.
People will contribute if ask them to support your undertaking in finding out the reasons fore mentioned above for submission to authorities both in malakal and Goss in Juba.I think this initiative will get support rather to pursue the court at this crucial moment the South Sudan is going through.

Thanks for your comments. I do not need to go to find out why the Chollo are still in the north up to now. You have answered the question yourself-Insecurity. About your so-called Chollo preconceived idea of a possible lost of our case in a court of law in South Sudan , due to Gol Deng being the majority judges, the Judiciary being non independence and politicized, this is nonsense. This is clearly a campaign by people whom I know have a hidden agenda. Your Dear Father Peter was my colleague in the National Assembly 1974-77. As a Medical Assistant, he told me that he had worked in Zelinge, Northern Provine and the Gezira. He met some of those he had known in his places of work. I do recall that there were people who would out of trust come to him for treatment because they preferred him better than northern doctors. For your information, professionalism decency is far above tribalism, politics, racialism, nepotism etc. The Gol Deng majority in every walk of life in South Sudan , cannot be avoided, but are you sure that they can sit in a room and decide to keep united in or to permanently rule the South? I tell you, despite Gol Deng numerical majority, they have always not used it for dominance over the rest of the south at our time. It is your generation now which is reminding them to use their majority. The highest office of Government in Sudan -The Supreme Council State was held by Sir Isa Ero, a Madi, Luigi Adwok, a Chollo, Pilimon Majok a Nuer, Jarvase Yak a Jur Cholo and Dr Pacifico Lolik, a Lokoya. Clement Mboro an Ndogo was Minister of Interior. Where is Gol Deng in this disappearing generation? Abel Alier , Dr John Garang and General Salva Kir all Gol Deng ,came on top by accident and not by Gol Deng Votes. There were others like Joseph Lagu, Gessimalla Rasaus, Joseph James Tumbua, Matthew Obur, Peter Gakouth and Angelo Beda and etc. If the Gol Deng majority has never been a factor in politics of the south ,how could they use it effectively in the field of professionalism?
I taught civics in school and I know that a Chollo medical doctor like my son Isaac Kwongo is now one of the people in Malakal taking care of all the dead or injured cases of those brought from Fangak, Kaldak , Dur, Malakal and more incidences . In short such descent professions like Health Education, Law and others cannot be dictated by the politicians for whatever reason to execute a bad goverment policiy. I understand that K.M.. Kwongo my former military officer in Anya- Nya1, is in Juba . I also read his letter to H.E. Salva Kir. I do not know what they might have agred upon if any Iam still going to Juba even without your money . My interest is just to see that while Iam alive, I should have a story to tell your own father and my other late members of our generation tomorrow that I have left the Chollo Kingdom still in tact in a New Country which we had fought for all our live time.
In conclusion, I know what you people are talking about. Your hope is built on the sand. The next president of the South Sudan is not going to be a Chollo man, not because we do not have capable men but because those in our forefront have already thrown their lots into the river. So you better look somewhere below this group and allay yourselves to the principle groups of the south in the following groups as follows in terms of population wise:: 1. SPLM, 2.Nuer, 3 Equatoria, 4 Awiel, 55 Bor, 6 Warrap, 7 Bor and Lakes 8 Bentiu with others, 8 Chollo going back to unite the south not for their leadership, but to be suggested by others. I have spoken and Iam going back to Juba to register my claim for our land before Salva Kiir issues decrees granting Warrants of Establishments of various States and Counties all over the New Country called the South Sudan . The SSLA which is predominately SPLM is going to pass the transitional Constitution of the country shortly, and it will be in one package with the decentralization system where the counties will be legalized by issuing them with the warrants of establishments. How will the Chollo proceed with Akoko map touching the rive Nile at Wicnyirial or Nyigir or Lul or Abaniim or Thworobwonyo? How would the Chollo proceed with the whole of the Chollo land from Nyijwado up to the Sobat River coming on the map of Jonglei? My sense is that you people have a hidden agenda in the hope that the international community will intervene and drag Salva Kiir to the ICC in Hague and therefore some of us may get the chance and save the South Sudan from being called a failed State. This wishful thinking, Iam afraid is just counting egges before they are hatched. Please think twice before you laugh over the initiatives of your elders.

Thank you so much for your comments. I am sorry to disagree with all the reasons you have given against the idea of going to the court which you think is predominantly,"gol Deng." whom you also claim we are raising a case against. First of all we are not raising a case against "gol Deng."We are petitioning to the court against the GOSS, because HE the President himself took the trouble of going to Malakal and convened a conference entitled," The Conference for Peace and Reconciliation between the Khor Fulus and Khor Atar Dinka Communities." The two Dinka Communities had been fighting since 2006 because they have been put together as one county and each side has been demanding that it should host the capital of the county. The President, the two governors of Jonglei and Upper Nile States and the chairman of the South Sudan Land Commission managed to make them stay together. Unfortunately, they chose Fiji as being central and therefore the Conference ended peacefully with the resolutions signed by two chiefs from each side, General George Athor and General Gier Chuang on their respective sides and the two governors and the chairman of SSLC signed as witnesses. I do not know whether or not they had the Maps of Jonglei and Upper Nile States in front of them. The Fact of the case is that Fiji is in Upper Nile State, while the county is for the residents of Jonglei State. If the idea was to change the boundary between the two states so as to extend Jonglei State into Upper Nile, why were the citizens of Upper Nile that were being affected by the new adjustment of the boundary not included in the conference?
As regards the court being predominantly gol Deng, may I delegate you to find out from Dr what he would do as a medical doctor if someone from gol Deng and another from Chollo were brought to him with very serious injuries in a fight between the two communities, would he treat the Chollo man and leave the other fellow? I do not think that the South Sudan has gone that far. If that was the case, why did you fellows not campaign in the Chollo Kingdom to vote against secession? I tell you that there is no way we can avoid gol Deng majority, whether in the civil service ,politics, church and so on. However, from our experience as elders, they are people who cannot keep together and you can even rule them, but do not alert them, because once you do so, they will rule you permanently.
About the Chollo globally to opt for the court case, I think this is a non -starter. This is a suggestion for plebicite. Who is to organize it and for how long and at what cost? Again, this idea of going for international Criminal court and human rights agencies, I have no problem with them, but do they have a ready solution for the so many small internal problems of a country to be born today?
My sense is this; The South Sudan has opted for secession in total. We have to believe in it, and build a sense of oneness and nationalism. No one is going to immediately listen to us on cases of genocide if we are targeting gol Deng leader. The International Community are still building cases against us, but they will not come in now. Our immediate concern is our people who are now in Kenana, Kosti, Assaliya, Medani, Gedaref, and Khartoum and so on. They need to go home to their ancestral land of domicile. You might be lucky to be in UK and people like Samuel Ongethi Ajing to be in USA. What about Jago Chol Ongethi, the Chollo paramount chief in Khartoum with all the rest of the Chollo IDPS over there, do they have to remain in the north as northern citizens? So to me talks about ICC, Chollo globally deciding on how we should proceed in the land crisis is a non-starter. All the same why don't we agree to hang together and finance my initiative as the one proposal in front of our eyes and continue to support any other idea that might come up in organized manner? I am told that the Reth is somewhere round Juba, If you can finance my round-about- ticket to Juba and to meet with him and the Chollo Community over there including those in both the government and the opposition and to decide how we can proceed from there , that would be great.
I hope I have made my position very clear. Any person or people who have genuine concern about our land case has the right to come up to present his or their project, otherwise any unnecessary Ifs and Buts are liable to suspicion of one having a secrete agenda.
